Please read these Terms of Service carefully before using the MarketOS platform. By accessing or using MarketOS, you agree to be bound by these terms. If you do not agree, please do not use our services.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and MarketOS ("we", "our", "us") governing your use of our marketing platform accessible at marketos.my. By creating an account, you confirm that you are at least 18 years of age and have the authority to bind your business to these Terms.
2. Description of Service
MarketOS is an AI-powered marketing platform designed for Malaysian SMEs. Our services include:
- AI content generation for social media and marketing
- Social media post scheduling and calendar management
- Customer Relationship Management (CRM) tools
- Search Engine Optimisation (SEO) and GEO features
- Ads management and performance analytics
- Marketing performance reporting and insights
We reserve the right to modify, suspend, or discontinue any feature of the service at any time with reasonable notice.
3. Account Registration
To use MarketOS, you must:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access to your account
- Accept responsibility for all activity that occurs under your account
You may not create accounts using automated methods or for the purpose of abusing our services.
4. Subscription Plans & Billing
Plans: MarketOS offers Free, Starter, Growth, and Pro subscription tiers. Features and usage limits vary by plan.
Billing: Paid subscriptions are billed monthly or annually in Malaysian Ringgit (MYR) via our payment gateway (Billplz).
Renewals: Subscriptions auto-renew unless cancelled before the renewal date.
Refunds: We offer a 7-day refund for first-time paid subscribers. Subsequent billing periods are non-refundable.
Price Changes: We will provide 30 days notice before changing subscription prices. Continued use after the change constitutes acceptance.
5. Acceptable Use
You agree not to use MarketOS to:
- Publish or distribute illegal, defamatory, or harmful content
- Violate any applicable Malaysian or international laws
- Infringe on intellectual property rights of third parties
- Send spam or unsolicited commercial communications
- Attempt to reverse engineer, hack, or disrupt our platform
- Create fake reviews, misleading ads, or fraudulent content
- Upload content containing malware or malicious code
We reserve the right to suspend or terminate accounts that violate these terms without notice.
6. Content Ownership
Your Content: You retain ownership of all content you upload or create using MarketOS. By using our platform, you grant us a limited licence to process and display your content solely to provide the service.
AI-Generated Content: Content generated by our AI tools is provided for your use. You are responsible for reviewing and ensuring AI-generated content is accurate, lawful, and appropriate before publishing.
Platform Content: All MarketOS branding, software, documentation, and original content remain our intellectual property.
7. Privacy
Your use of MarketOS is also governed by our Privacy Policy and PDPA Compliance Statement, which are incorporated into these Terms by reference.
8. Third-Party Integrations
MarketOS may integrate with third-party services (e.g. social media platforms, payment gateways, AI providers). Your use of such integrations is subject to the respective third-party terms of service. We are not responsible for third-party service outages, changes, or policy violations.
9. Disclaimers & Limitation of Liability
MarketOS is provided "as is" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free service
- Specific results from AI-generated content or marketing features
- Accuracy of third-party data or analytics
To the maximum extent permitted by Malaysian law, MarketOS shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability to you shall not exceed the amount you paid in the 3 months preceding the claim.
10. Termination
Either party may terminate the agreement at any time. Upon termination:
- Your access to the platform will be revoked
- You may export your data within 30 days of termination
- Outstanding payments remain due
We may immediately terminate accounts for serious violations of these Terms.
11. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes shall be resolved through the courts of Malaysia, with Kuala Lumpur as the agreed jurisdiction.
12. Changes to Terms
We may update these Terms from time to time. We will notify registered users via email at least 14 days before material changes take effect. Continued use of the platform after that period constitutes acceptance.
